• I got into a car accident. Am I at fault?

    I had a green light and was driving when I heard an ambulance a car atleast 4 cars ahead of me slammed on their breaks in the middle of the intersection and caused 4-5 cars to rear end eachother.     I had a green light and was driving when I heard an ambulance a car atleast 4 cars ahead of me slammed on their breaks in the middle of the intersection and caused 4-5 cars to rear end eachother. I slammed on my breaks to keep from colliding with them but I couldn’t stop in Time. When I hit the car I went forward and now my shoulders,neck and head are starting to hurt. Am I at fault for not stopping ontime ?

    My boyfriend got in a car accident with my car while I was in school, the guy was at a QT gas pump and was on his phone and ran into the driver side door of my car while my boyfriend was waiting for someone else in front of him to move. My door no longer opens from the outside and theres a huge dent and scratches. The guy admitted to being at fault and we did an insurance claim but there was no police report filed and his insurance wants my insurance info. I now don't know what to do because I don't want my insurance to go up because we weren't at fault.

    I was driving on the freeway and this Mercedes in front of me slammed its brakes and I did too, but I ended up rear ending her vehicle. We exchanged info and we "agreed" that she would take it to her mechanic and I would pay the bill. We drove off and that was that. Two weeks later I get a call from my insurance company stating if I was in an accident and if the car I drive is a Mercedes. I said no, I drive a Toyota. Then he said that Jane Doe was the one that filed the insurance claim with my insurance stating that her Mercedes was hit. I told him I was John doe and my Camry was the one that hit the Mercedes and the insurance he was calling from was my insurance and that Jane Doe had a different insurance company. Confused, the guy told me that he would get back to me because he didn't understand What was going on, I asked him why she would file an insurance claim under my insurance and putting her vehicle on my insurance and he said he didn't know and would get back to me. I'm really confused myself as to how this could happen in the first place, can someone do something like this or is it illegal? If this information helps, I do remember that she told me that she didn't want to get anyone involved was because she had a ticket on her record or something like that. She told me this when the accident had occurred.

My basic understanding of this would be if car driver A rear ends car driver B resulting in damage to either or both cars and possibly some injuries, driver A is at fault but both drivers would need to claim from their own insurance agents. Driver B can not claim against Driver A's insurance agent like in an at fault state. My understanding also is that in a no fault state such as Florida, driver B does not have any option to sue driver A unless a substantial amount of damages are involved. Supposing though car driver A rear ends car driver B and driver A is uninsured. In a situation like this, does driver B still have to claim against his own insurance or would driver B then have the option to sue driver A personally? I realize that if driver A were to be uninsured, it may not be worth suing as uninsured drivers usually have no money or assets to collect from, but is it a possible option?

    Stop and go usage -- check. Half of the miles are S&G. That's rough on an engine.

    Dusty conditions -- check. Even on a day that does not appear to be very dusty, in the desert every day is a dusty day as far as your engine is concerned.

    Now, let's go have a look at the owner's manual again. It may say that oil and filter should be changed every 7,500 miles or 6 months, whichever comes first, but let's look a the severe use recommendations. Light usage, high operating temperature, stop and go driving, dusty conditions and towing heavy loads all qualify as severe usage by themselves. You have 4 out of 5.

    I'll wager without looking that for severe service, the manual recommends oil and filter every 3,750 miles or 3 months, whichever comes first. Frankly, the dealer is recommending a less frequent service interval than the factory does.
