Can I pass a cop if he is only going 75 in a 65 legally?

If it is a 65 zone and you are driving in excess of that, whether overtaking or not, you should expect to be given an infringement notice. There is no excuse. There is nothing you can do to dispute that. If you want to criticize the Police for their speeding go ahead but don't expect to be making any friends.

Witnessed it myself...I was doing about 70 in a 65 behind a cop in the right lane. An idiot passed us both doing ~75-80. Right after passing the cop, the lights came on...

Sure, as long as you are going the other direction at or under the speed limit for the direction you are traveling.

Exceeding the speed limit is illegal. That is why it is called a "limit."
