My husband got selected to serve on A jury in CO. His work told him he had to come in after jury duty was over. Can they do that?

    Your husband's first responsibility will be jury duty. He may be required to come into work if it does not last a whole day but he cannot be fired for doing his civic duty.

    Your husband should mention that to the judge. Your husband's employer might think differently after having a, well, polite, uh, conversation with the judge.

    Most states have laws that prohibit employers from engaging in threatening or retaliatory tactics if/when you serve on a jury.

    Colorado state law says, "State law protects a juror's job; an employer shall not threaten, coerce, or discharge an employee for reporting for juror service as summoned. An employer shall make no demands upon any employed juror which will substantially interfere with the effective performance of jury service."

      If they make him work half a shift - after spending a full day at the courthouse - he would report the next day for jury duty sleep-deprived. Which absolutely would "interfere with the effective performance of jury service."

    If jury duty doesn't take the whole day, your employer can expect you to come in and finish the day - or take vacation.

    It depends entirely on how it works where you live. Even different cities can have different rules.

    When I lived in Boston, the Municipal Court only held you there until noon if you didn't get empaneled. If not (and most days it was not) they let you go at lunch.

    What do you mean, "after jury duty was over"? Do you mean evenings after his day in court? Possibly not - you need to look up the law in Colorado. Employers are supposed to give time off for jury duty.

      But yes, if jury duty took only half a day, they can require you to come in for the other half.
