Is racism criminal or free speech?

Depends on the context. If it’s just Verbally making a racist comment to somebody in a non-professional setting, it’s probably considered freedom of speech I would guess. To be honest I’m not sure about that though. But if somebody refuses to rent you an apartment because of your race, in Most jurisdictions it would be considered a violation of the law .

It is criminal to commit first degree murder and it is a felony to try to talk someone else into committing first degree murder. So it cannot possibly be ethical to commit genocide or to persuade people to commit first degree murder times millions of victims.

Hate talk, threats, defamation, libel, inciting to violence, and similar are not protected by the Second. So if the racism includes any of these the racist is breaking the law. [https://www.business2community.com/social-media/7-...

Racism, along with all the other "isms", is thought not speech nor action, and people can't be prosecuted for their thoughts. Racist speech is protected speech but racist actions often CAN be prosecuted.

Free speech. We have a right to be a racist if we want to, a right to believe what we want to, think how we want to think, like who we want to like, dislike who we want to dislike, and if you don't like it, too bad. It's called "freedom". Some behaviors won't win a popularity contest but, they are perfectly legal.Source(s): Certified Paralegal, with 25+ years' experience.

It is neither. First you must define what you consider racism.Classic racism is the belief in the superiority of one race over another. It may also include prejudice, discrimination, or antagonism directed against other people because they are of a different race or ethnicity, or the belief that members of different races or ethnicities should be treated differently. There are very few true racist in the US. There are a lot of bigots and people who are prejudice, but that does not constitute racism. On the free speech aspect. "free Speech" is based on the Firest Amendment which say "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." The important word is "Congress". It does not mean you can say anything you want without there being some consequences.
