If someone came to the uk in 2017 on a spouse visa and the documents submitted were falsified what will happen?

The person has two children they brought over to the U.K but the children were born in Bangladesh. because the husband-spouse(sponsor) is a British citizen and therefore the children can obtain citizenship due to their father. Can the home office cancel the visa even if the person has been in the UK for two years and has two children, one is 15 years and the other is not a child anymore she is 20? The employment details submitted by the spouse were false. What will the outcome be?

  • The spouse visa allows initial entry clearance for 2.5 years. The extension criteria require the applicant to furnish the documents again. Having provided false documents may lead to false representation and doubting the credibility of an applicant this may lead to a country ban.

    Your initial spousal visa is about to expire as it was for 2.5 years. Sponsor will apply to extend for a further 2.5 years. If tax returns show that the previous income statements were false, the extension will be refused.

    If that happens you will have to return to Bangladesh.

    If your two children are British citizens through their father and hold British passports, they will not be affected as they have an unconditional right to live in the UK completely outside any issues their mother might have. If they do not have Great British passports, they will need to leave with their mother and can return when they have their passports.

    A mother gets no immigration rights from her children.

    Of course your visa will be revoked. Getting away with fraud for two years is no reason to let you continue to get away with fraud.

    That's fraud, grounds for revocation of any visa/immigration benefit. Prove the fraud to appropriate immigration authorities and the foreigners must return to their country with permanent bar to reentry. If you are the foreign spouse, best you divorce & take your kids home to Bangladesh before you get deported.
