Why is Pactiv, a plastic food container maker, exempt from stamping recycle code on their plastics?

    Presumably, for the same reason any U.S. packaging manufacturer is.

    Because there is no federal requirement in the U.S. to do so.


    But what is your source for the claim they are "exempt?"

    Since they obviously do mark their products:

    There are exemptions for small containers (including jar lids) and for materials that are not amenable to stamping, such as LDPE grocery bags. There may be others.

      As an example of why I have no reason to believe that the claim in the question is accurate - this is a link to one of their products.  In the photo you can clearly see the stamp that the asker claims they are "exempt" from using.
