My city said 8pm curfew for all non protesters. Protesters can stay out as long as they like.?

The police said they will make sure protesters get to their car or homes safely whenever they decided to end the protest. Is this legal? Can the city set a curfew for a certain population of the city but not the other?

Update:

The constitution is not supposed to restrict religious freedom either but they are doing it.

    Given that they Constitutionally cannot restrict ones ability to protest, yes.

    I would think not. Then again, you could go out to the store, and if you get stopped, just say you're protesting the curfew.
