If someone tries to poison a person but gets caught in the act and murdered by that person will they be charged for murder?

    Yes.  The appropriate response to discovering that someone is trying to poison you is to notify the police, because at that point, the moment you have discovered the attempt, the threat is ended. Once the threat is ended, any harmful action you take becomes criminal conduct for which you can be charged.

    Yes, of course they would. The proper action would be to contact the police, not take revenge by committing murder! The situation you're describing wouldn't even be considered "self defense."
