No it wouldn't be rape because you consented to having sex with that person
Regret doesn't equal rape

Any normal trans person would explain that they were trans before any intimacy so that the other person cannot say that they didn't know and weren't warned.

If you have sex with a trans person, it means that if you were attracted, excited and CONSENTED, that is not rape.

Yes, this qualifies as rape or sexual assault, as this is rape by deception, and by using the omission of relevant facts regarding the gender of an individual, there is no consent provided.
It's incumbent on each partner to fully discuss their gender so the other partner understands that they are engaged in intimate relations with a former or current member of their gender. Put simply, they will be having sex with an individual, which will imply homosexual relations, something that may offend their morals.
Therefore, this is a crime of rape.

Rape is sex with out consent.
As the second person did not say no, its not rape. Now if the trans person did not live up to the expectations of the Cis person, that is not their fault.

And more and more trans women are going to jail for it.

Trans people are exactly who they say they are, so, nope.
Don't blame trans people for your own ignorance/phobia.
